Please read these Terms of Service ("Terms") carefully before using the TrustMFT managed file transfer platform ("Service") operated by TrustMFT ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
By accessing or using the Service, you confirm that you are at least 18 years old, have the authority to enter into these Terms on behalf of yourself or your organisation, and agree to comply with them. If you do not agree to these Terms, do not use the Service.
TrustMFT is a cloud-based managed file transfer platform that allows organisations to securely upload, store, and share files with clients and partners via a web portal and SFTP. Access is provided on a subscription basis.
You must provide accurate and complete information when registering an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at legal@trustmft.com if you suspect any unauthorised access to your account.
New administrator accounts require email verification before login is permitted. We reserve the right to suspend or terminate accounts that we believe are being used fraudulently or without authorisation.
You agree not to use the Service to:
All uploaded files are automatically scanned for malware. Files that fail the scan are quarantined and made unavailable. We reserve the right to delete quarantined files.
You retain all rights to the files you upload. By uploading files, you grant us a limited licence to store and process them solely as necessary to provide the Service.
You are solely responsible for the files you upload and share. We do not review the contents of files except as required for malware scanning, troubleshooting, or legal compliance.
Your account is subject to storage quotas and per-file size limits set by your subscription or your administrator. Uploads that would exceed these limits will be rejected. You are responsible for managing your storage usage within the limits of your plan.
We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. The Service is provided on an "as is" and "as available" basis. We may perform maintenance that temporarily affects availability, and we will endeavour to provide advance notice where practicable.
The Service, including its software, design, and documentation, is owned by TrustMFT and is protected by intellectual property law. These Terms do not grant you any rights to our trademarks, logos, or other proprietary materials.
Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the data practices described in the Privacy Policy.
The Service allows you to generate shareable download links for files. You are responsible for the links you create and the recipients you share them with. We are not responsible for the distribution or misuse of links you share. Links may be revoked at any time through the portal.
You may cancel your account at any time by contacting us. We reserve the right to suspend or terminate your access to the Service immediately, without notice, if you breach these Terms or if we determine that continued access poses a security risk to the platform or other users.
Upon termination, your right to use the Service ceases immediately. Your data will be deleted within 30 days of account closure, subject to any legal retention obligations.
To the maximum extent permitted by applicable law, TrustMFT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising under these Terms shall not exceed the fees paid by you (if any) for the Service in the three months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the portal. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
